Even supposing that Joe Jackson was abusive toward Michael Jackson and others in the family, does this necessarily mean that he is not a good grandfather today?

It is often the case that people mellow out as they get older. Sometimes the most severe and demanding parents become the most loving toward their grandchildren. There should be no presumptuousness on the part of the court. Let the other grandchildren testify as to whether Joe is a good grandfather before making a decision on whether to award custody of Michael's children to Katherine Jackson.

Was it In-Vitro?

In the garden of Eden, the serpent first spoke to Eve and assured her that she would have knowledge of Good and Evil if she just ate of the forbidden fruit. Eve was deceived and then convinced Adam to eat of the fruit.

This pattern took place again in the case of Deborah Rowe and Michael Jackson. Deborah was deceived by the allurement of riches. She knew that he wanted children badly. She then offered to bear the children in exchange for money, to be conceived by artificial insemination using the seed of an anonymous sperm donor. Jackson then agreed to the proposal. This set in motion a series of events bringing about sorrow and grief.

Deborah has been quoted as saying that she conceived both children through a process which was the same as the way she would inseminate one of the mares on her horse ranch in Palmdale. Presumably this would be by extracting live sperm from one of the stallions and then injecting it into the vagina of the mare either directly using a syringe without a needle, or by way of a tube inserted into the vagina. This is ethical as a breeding technique for thoroughbred horses. However, it is totally unacceptable as a way to bring human beings into this world.

Although it was Deborah's idea initially, Deborah and Michael are in pari delicto which means that they are equally at fault. They both suffer the consequences of these sins. In law, when two parties are in pari delicto, the one in possession has the better right. Applying this rule to the Jackson children, they were in the custody of their father at the time of his death and are now in the custody of their grandmother. The law favors her to continue having custody.

As shown in the picture at right, it is becoming more and more evident that Michael Jackson was not the biological father of the two oldest Jackson children. The obvious similarities to Debbie Rowe substantiate her claim that she is the biological mother of the two.

There was no need for Jackson to adopt either of the two. He is the father of the two by virtue of his being married to their mother at the time of birth.

Debbie Rowe's claim that she is entitled to custody is weakened by the fact that she apparently conceived both children for the motive of financial gain, and the fact that there was no consummation of the marriage. Since Michael had sole custody of the two oldest children after the divorce in 1999, and the youngest was conceived thereafter, his mother Katherine is the grandmother and should be considered next of kin and awarded custody on that basis.

Jackson Offspring Should Go to Next of Kin

As shown in the picture at right taken on November 27, 2008, Michael Jackson's three children bear a strong resemblance to their father. Michael Joseph Jackson Jr. is pictured on the left, Paris Michael Katherine in the center, and Michael II at bottom of photograph. Obviously they have a darker complexion than the two other children who are unrelated. It is often the case that children of a white mother and a black father have a skin color somewhat in between. Each of the children also has brown eyes, with the daughter's being a lighter color.

Deborah Rowe contends that she is the biological mother of the two oldest Jackson children, and that they were both conceived through artificial insemination. Whether or not this was done in vitro is still an open question. Michael Jackson has stated in an interview that he is the biological father of the youngest child also conceived through artificial insemination, the mother being unknown.

Deborah Rowe and Michael Jackson were married on November 14, 1996 while Deborah was pregnant with the first child and remained married until after the second child was born. There is a presumption in California that the biological mother is the mother of the child at the time of birth, and since both children were born during the marriage, they shared custody of both children until the marriage ended in divorce on October 8, 1999.   The presumption that the biological mother should have custody is rebutted by the fact that Deborah Rowe bore both children to term for the motive of financial gain, and the fact that marriage was apparently never consummated.

The daughter Paris Michael Katherine shares one name with her grandmother Katherine Jackson. Michael Jackson clearly intended in his will that Mrs. Jackson should have full custody of all of the children, and that Diana Ross should have custody only if Mrs. Jackson was unable or unwilling to care for the children. He also intentionally omitted to provide for his former spouse Deborah Rowe. To give custody of the two oldest of the children to one guardian and the youngest child to another guardian would unnecessarily break up the family.

Under these circumstances, the court should grant Katherine Jackson full custody of the three children, with some visitation rights allowed for Deborah Rowe and the two oldest children only.

Surrogacy, In-Vitro, Stem Cells, Cloning. . .What Next?

The problems raised by Michael Jackson's estate bring to the fore the complete lack of foresight bringing about chaos through liberal ideology. The three children in question were all apparently conceived in vitro, the first two carried to term by Jackson's ex-wife Deborah Rowe, as a surrogate or "breeder", the third having been carried to term by an unknown surrogate. The legality of all of this is highly questionable. If a couple or individual can pay a "fertility clinic" to manufacture embryos and/or implant preexisting embryos into the womb of the contracting spouse or individual, or another surrogate unrelated to the contracting parties, what is there to prevent women from getting pregnant as "surrogates" for others with no intention whatsoever of raising their offspring in a healthy environment? Is this not the equivalent of slavery? The very acts of in vitro fertilization and implantation cause injury and harm to the child to be conceived and born by depriving that child of a God-given right to be conceived through a loving marital act. This is not a right devised by man, and it cannot be abrogated by man. The participants also harm themselves, particularly the man who provides the seed for conception through a deliberate act contrary to his own male nature.

Since these children are harmed from the gate, should we allow any of the contracting parties to have custody of the children? The children have already been exploited as a means to an end by the adults involved including doctors and fertility clinic operators. Should we now add insult to injury by giving custody to one or more adults who are in pari delicto and who have caused this injury? We see the results of taking this approach in the way Jackson treated the youngest boy by dangling him over a balcony in a Berlin hotel with face covered, and the child being then given the derogatory nickname "Blanket" which will probably stick for the end of his life.

In order to stop these terrible practices, our courts will have to rethink the entire notion of "reproductive rights", including the question of whether prospective rights exist for all human beings which precede conception and are above the state and man-made law. Only then will we be able to protect these rights for everyone.
