Status Quo? Don't You Guys Want Change?

The opposition to the Stupak amendment in Congress and in the Mainstream Media is now being portrayed as an attempt to preserve the status quo of the Hyde Amendment limitations. They conveniently ignore the fact that most Americans oppose government funded abortions, and that an explicit, overt prohibition on abortion funding is necessary in any health care bill to make circumvention of the funding prohibition punishable by law.

These liberals are playing politics with our lives. It is time to force them out of the closet. Do they want abortion funding or not? If not, why are they against putting a ban on funding in the bill? Americans don't care about the status quo. They only want to make sure that tax dollars are not used to pay for abortions, or to subsidize organizations or health care plans that provide abortions whether or not the actual payment for abortions comes out of federal funding.

Is Right to Health Care in Constitution?

The Tenth Amendment reserves to the states or to the people all rights not specifically enumerated. The Constitution gives Congress the express power of the purse. This means that only Congress has authority to decide how tax revenues are spent.

Whether or not required by the Tenth Amendment, prudence following the principle of subsidiarity would dictate that state and local governments should be in charge of health care. The primary responsibility rests with the individual and families. Government has an obligation to assist only where necessary.

Will liberals in Congress derail health care over abortion? Probably not. Sixty votes are only needed in the Senate to overcome a procedural obstacle, not to pass the legislation with or without inclusion of the Stupak amendment or similar pro-life language.

Will the Stupak amendment come back to haunt Senators and Representatives in the years ahead? We can expect a shift in the balance of power after 2010 and possibly a new administration in 2012. This is before health care reform gets off the ground. There is plenty of time to add explicit pro-life language at a later date. The Stupak amendment is at least a noble beginning.

Obama's Birth a Red Herring

The question of where Obama was born is a distraction to shift the focus away from the real reason why he is unqualified to serve as President of the United States. Kenyan officials and relatives of Obama have a vested interest in saying that he was born there to promote their own country. The real question is not one of birth, but of parentage.

Barry Obama's status follows that of his father. When born in Hawaii in 1961, Obama was a subject of the British Crown like his father. He only obtained US citizenship by virtue of the Fourteenth Amendment.  Hence he is not a natural born citizen.

The question is one of remedy. The federal court in exercising jurisdiction is called upon to decide whether Barack Obama can actually prove that he is qualified to be President. Citizens have a right to demand that our government leaders, and the Commander in Chief in particular, are qualified to hold public office. Because of the separation of powers, it is doubtful whether a federal magistrate can remove someone from the office of President. Congress alone has that power through impeachment proceedings. However, the Constitution only allows impeachment in the case of "high crimes and misdemeanors".

It is worth noting again that Barack Obama took the presidential oath twice, because in the first ceremony there was a defect. This basis of impeachment will have to be fraud on the electorate, which will require proof of intent. This will be difficult to prove in Obama's case, mostly because of prior cases of unqualified candidates running for office.  The court could at some point, however, issue an order barring Obama from seeking reelection in 2012.

Article II, Section 1 not Superceded by Fourteenth Amendment

In the previous post, Barry Obama's fraud in running as a Democrat candidate for President was discussed. It might be added that there is evidence of Obama's foreign birth in Kenya introduced in the case of Barnett et al. vs. Obama. Depending on the outcome of this case, Obama may not only be ineligible to serve as President, but may be subject to deportation back to Kenya if it is found that he was actually born there. There is also some question as to whether Obama had prior knowledge of his foreign birth, if indeed that was the case, before running for President.

The Fourteenth Amendment's definition of U.S. citizenship to cover all persons born in the United States, and subject to the jurisdiction thereof, cannot reasonably be construed to broaden the citizenship requirements for federal public office enunciated in Article II, Section 1 of the Constitution. Moreover, any subsequent Congressional statute can have no bearing on the classification as a "natural born citizen" of Article II, Section 1, insofar as the legislative branch has no authority pursuant to the Tenth Amendment to redefine this terminology or to expand the class of persons eligible to serve as President or Vice-President.

In American history, Chester Arthur was never qualified to serve as Vice-President under Garfield, nor as President after Garfield's death in 1881. Timely objections were raised based upon his father being born in Ireland and not having been naturalized at the time of Chester's birth in 1829.

Barry Goldwater was not eligible to serve as President when he ran in 1964, because at the time of his birth in 1909, the Arizona Territory was not a state within the Union.

John McCain was not eligible when he ran for President in 2008 because he is a Panamanian citizen born in Panama in 1936. Furthermore, he is not qualified to serve in the United States Senate.

None of this has anything to do with fairness. It is about limited, constitutional government. Even if Obama was born in Hawaii in 1961 as he contends, this only makes him an ordinary citizen pursuant to the Fourteenth Amendment. He is still ineligible to serve as President by virtue of his not being a natural born citizen within the meaning of Article II, Section 1 of the Constitution at the time of its ratification in 1787.

Barry's Last Stand

The usurper Barack Obama's time in office is running out.

The federal action Barnett et al. vs. Obama raises the key question of Obama's eligibility. Like it or not, in the final analysis, the question comes down to whether a person with the same parentage status would have had the necessary qualifications to run for federal public office at the time the Constitution was ratified in 1787. By redefining citizenship requirements, Congress cannot expand the qualifications to hold office as laid down in the Constitution.

In my judgment, the question of the question of the location of Barry Obama's place of birth is a red herring. This is the real reason why the Obama camp will not divulge the actual birth certificate. In leaving this question open, the focus is taken away from the real reason why Obama is not qualified.

If in 1787, a person's father was a foreign born subject of the British Crown, that person would not have been qualified as not being a natural born citizen. Barry's father had never renounced his allegiance to the British Crown based upon his citizenship in Kenya at the time of Barry's birth in 1961. Therefore, whether Barry was born in Kenya or Hawaii, his status is still that of one who is not a natural born citizen. He was never qualified to become President for this reason.

The 2008 presidential election was invalid. Obama and Biden will be removed from office once this becomes clear. All of Obama's appointments, including that of Justice Souter's replacement and the numerous czars, are likewise invalid. There will have to be a new election, and a new Supreme Court appointment once the new president is sworn into office. In the meantime, Nancy Pelosi will be the interim president as next in the line of succession.

Health Care Reform on the Way

As congressional leaders get more input from the concerns of real Americans, the liberal health care plan is sinking. There still is a real need for better health care. The likely result will be a boon for private insurance companies who will receive increases in premium revenues as Americans without health care coverage will be required to obtain some type of coverage to decrease per capita costs. The public option will not suffice, because of widespread opposition due to the failure of the Medicare system.

There will also have to be specific restrictions on abortion, sterilization and contraceptive funding which should never be considered as health care. In fact, state laws will be needed to prohibit insurance companies from paying for these services and prescription items.

Because of the push to mandate coverage of pre-existing conditions, which only makes sense when all are covered, medical premiums should be expected to rise. Employers will be expected to bear the brunt of these cost increases and we can expect that health insurance will become mandatory for all full time employees, again to help pay for the cost of covering more people.

There may be some cost reductions because of preventive care and elimination of emergency treatment for the uninsured.

Without the public option, we can expect less fraud and waste. This also leaves open the possibility for transitioning on a grand scale to privately operated medical cooperatives in which everyone has a voice in deciding what care is provided at the local level, and at what cost. The federal government wants to control health care.  It is only the voice of voters which keeps government in check. However, decentralization will only happen when Americans decide to take responsibility for their own health and well being.

Let's Have Some Real Health Care Reform

The Obamaites in the media continue to repeat the mantra that the Obamacare proposal will not force American taxpayers to pay for abortions. Yet it was the same Obama administration that scuttled the Mexico City Policy so that they could fund abortions abroad with our tax dollars. How can any intelligent American believe that this plan drummed up by Rahm Emanuel will not lead to government coercion to kill the terminally ill and elderly among us? Rahm's brother Ezekiel, chairman of the department of bioethics at the National Institute of Health, has himself made the point that the bill will use a person's age as a basis for denial of health care benefits because older Americans theoretically will have had greater access to health care when they were younger and able to work. Rahm again is only looking out for Israel where abortion is against the law, and he is trying to weaken America so that Israel will not be left out in the cold after decades of dependency on America.

This health care plan amounts to treason by Obama and the liberals in Congress. America cannot wait until the killing of our senior citizens, and citizens with serious disabilities, becomes commonplace. We must act now to bring the traitorous scoundrels to justice. America must act independently in order to promote good in the world. This isn't just about grandma anymore. It is an attack against America.

Obamacare Only Tip of Iceberg

Health care is only the tip of the iceberg. Anger and contempt for federal and state government have been building up for decades, and all because of betrayals and mismanagement of the few in government which were distorted by mass media outlets.

Take for example the case of Terry Schiavo. There was absolutely no reason for her to die. The courts promulgated a grave injustice equal to, if not worse than, racial segregation. President Kennedy used federal marshals in 1963 to stop racial segregation despite objections by governor George Wallace standing outside the classroom door in Alabama. Why could not something similar have been done for Terry Schiavo? Either of the Bush brothers could have acted to save a woman's life. If anyone was ever deprived of constitutional rights, she was. Yet there was no action forthcoming either in Florida or at the federal level. So why should Americans believe that the government cares about their health or well-being, and stand back idly while Congress and the President set up another Draconian nightmare of bureaucratic red tape? Has this socialistic approach ever worked in the past?

John McCain brilliantly began to tap into this groundswell in nominating Sarah Palin as his vice-presidential running mate. The trouble was that he didn't follow through. McCain was overly committed to the neo-conservative agenda of Randy Scheunemann and Joe Lieberman who perceived Palin as being a major threat to war funding for Israel. McCain refused to allow her to let the genie out of the bottle by addressing the pro-life gathering in Minnesota outside the convention. Taking this subject off the table in 2008 only unleashed the anger expressed at town hall gatherings in 2009. Today, most Americans feel betrayed by Congress, the President, and the Courts, and rightly so.

It may well be that this betrayal is a manifestation of the stage of capitalism in which we are now living. Any society that takes selfishness to the extreme to which America has done, and has deliberately shunned religion and morality from public life, will be faced with big problems.

Liberals in government have dug themselves into a deep hole. Like their predecessors during the French Revolution, they are now forced to either accept a flawed agenda of more and more government sponsored killing, or put their own careers and lives in danger because their past actions are criminal and punishable by any just standard of law. Let us hope that our nation can resolve these conflicts and not fall into the cycle of reprisals for past misdeeds.

USA Indian Giver

Our government obviously does not comprehend how capitalism works.

By encouraging sub-prime lending to get more housing for their minority constituents, the Congress led by Barney Frank and Chris Dodd brought about the housing bubble leading to the financial crisis and drop in securities values.  In deregulating Wall Street, what did they expect the brokers were going to do, not make more money in a competitive market?  Selling derivatives was an easy if unethical way to make money.

So what should be done with AIG?  As a cousin of mine in the DC area has suggested, let them keep the bonuses but in AIG stock rather than in cash.  And if I might add, at the market value of the company stock at the time the contract bonuses were negotiated over a year ago.

O'Bummer Economy

Mistakes always have consequences.

When G.W. Bush first took office and America was already too far in debt, VP Cheney believed that deficits don't matter.  What Bush did after September 11 was to commit America to spending an unlimited amount of money on a war that no one knew what it was about, and no one knew whether or not we could win.

Meanwhile, the Democrats in Congress led by Frank, Dodd and Pelosi, were creating a guaranteed insurance incentive for the financial sector to abandon good lending practices and start making bad loans to put minority and immigrant families in homes that they could not afford to live in, and where their neighbors did not want them to live next door anyway.  They simply do not have the skills to deserve living in upper middle class neighborhoods.  So naturally many of their homes were and are taken away in foreclosure.  The Democrats in Congress basically needed friends because they were so unpopular with ordinary Americans and for good reason.  This is really what redistribution does.

Government trying to stimulate the economy by spending or giving away to create demand is a ploy that simply doesn't work.
