Herman Cain's problem runs far deeper than a single incident involving an employment dispute. He fits the classical profile of a serial sexual harasser, the kind that end up having to register as sex offenders.
It is wrong to make light of the situation by continually repeating the worn out excuse that employers often settle out of court. These cases are usually settled by insurance companies who then have to pay the injured claimants and who have a responsibility to pay claims only if they have some merit. The persons making the claims have the burden of proof as to whether an incident of sexual harassment actually occurred. If they are lying, they could end up losing their jobs and having to pay court costs and attorneys fees for the employer.
Fraudulent claims are brought in all types of situations, not just sexual harassment cases. We cannot draw the conclusion that just because a case was settled out of court, and non-disclosure agreements were signed, that the claims must have been frivolous from the start. There would be no point in settling claims of this type and then coming back years later to challenge and confront the alleged perpetrator outside of court unless wrongdoing actually occurred. It is also highly unlikely that multiple accusers would come forward alleging the same type of misconduct occurring within a three year period twelve years ago unless the allegations have substance. Furthermore, we do not know why Cain left his position as head of the association before the expiration of his three year term. This again raises suspicion that he has something to hide from public scrutiny.
