A Spanish judge, Baltasar Garzon, has ordered an inquiry of alleged war crimes committed against Spanish citizens and resident aliens by Americans at Guantanamo. The Spanish Court is basing its jurisdiction on treaty commitments including the Geneva Conventions.
The U.S. has the same authority to indict American politicians and judges pursuant to the legal principles established at Nuremberg in 1946.
The debate in America has so far revolved around overturning unacceptable and flagrantly unjust court decisions. What has been overlooked is the precedents for punishing those in power who have seized upon this issue for their own ends.
Obama can start the process by making sure that his next court appointments will vigorously prosecute the political opportunists in and out of government who are most responsible for the untimely deaths of millions of Americans. If he fails to do this, he will lose in 2012 and the court will then change direction with a pro-life majority.
